Guilty of ending a "harmonious marriage"

In Mexico, a mother was looking for her son’s father to pay child support. Because of his refusal, she told the father’s wife the situation. The current wife sued her for moral damage. The court sentenced the woman for breaking the harmony and dignity of the marriage.

When a father failed to make child support payments, the child's mother decided to send text messages and emails to the man's wife letting her know that her husband had a son with her that he was not taking responsibility for.

The man's wife filed a claim for moral damages against the woman, considering that, the woman suffered by being informed that her husband had a child with another person during his marriage. 

The Fourteenth Civil Judge of the Common Jurisdiction of Mexico City stated that the woman had no right to disturb the marriage. The Court claimed that the woman was not satisfied with having a relationship outside of marriage so she caused moral damage to the man's wife. The judge also found that the messages affected her psychological health, the marital harmony of the couple and the wife’s dignity. As a result, he ordered the woman to pay 50,000 Mexican pesos (2,500 US dollars) and issue a public apology to repair the supposed damage she caused with the messages. 

The judge in this decision punished the woman for behaving in a way he deemed "morally unacceptable,” intervening in a marriage by having a child with a married man and daring to tell his wife. However, the judge did not address the father's failure to provide for his son, which was the reason the woman sent the messages. In this way, the judge conducted a moral analysis rather than a legal one and failed to take into account the woman’s attempt to get the father of her son to abide by the law.

    El juez debe enjuiciar con fundamento a las leyes existentes y no puede inventar delitos que no existen, lo qu hizo este "juez" es completamente ilegal. Es "juez" ignorante, mal servidor público y peor funcionario de gobierno.

    Creo que antes de señalar y "juzgar" la forma en que resolvió el juez, en primer lugar deberian de tener la sentencia completa para asi poder opinar, ya que al solo dar un "resumen" fuera de contexto, en ningun momento discuten, o señalan, si se acreditaron o no los elementos de la accion, ademas de que un juez civil no tendria, ni mucho menos podría, pronunciarse respecto a lo referente al incumplimiento de la obligación alimentaria a cargo del padre, deberian de dejar de mal informar a la gente y evitar que se confundan al no tener conocimiento sobre el tema.

    Al postular esta sentencia no están teniendo en cuenta la posición en la que están ustedes poniendo a la demandante. Hay que tener en cuenta que ella como esposa no tiene porqué responder por las acciones de su esposo, lo que hace que los mensajes personales constantes se comporten como una forma de acoso. De acuerdo en que el argumento de que la demandada no tiene el derecho a perturbar el matrimonio es sexista, sin embargo no se le puede demeritar su acción diciendo que no se refirió al tema de alimentos pues el no era quien conocía esa causa.

    Felicito a esta organización por el trabajo que están haciendo. Independientemente de las opiniones individuales, esta difusión de las sentencias obligará a los operadores jurídicos a juzgar con perspectiva de género
